Consultation on the draft transposition of Directive 2014/53/EU

The Government, through the Secretary of State for Infrastructure, has decided to hold a public consultation on the draft legislation establishing the regime for making available on the market, putting into service and use of radio equipment, transposing into the Portuguese legal system Directive No 2014/53/EU of the European Parliament and of the Council, of 16 April 2014, on the harmonization of the laws of the Member States concerning the making available on the market of radio equipment. To that effect on 9 June 2016, ANACOM was requested to promote this consultation, under the framework of its terms of reference of providing assistance to the Government. The draft now submitted for consultation repeals Directive No. 192/2000, of 18 August, establishing the regime for making available on the market, putting into service in national territory radio equipment and telecommunications terminal equipment, as well as the regime for the respective conformity and marking assessment, which transposed into the Portuguese legal system the standards of Directive 1999/5/EC of the European Parliament and of the Council, of 9 March, on radio equipment and telecommunications terminal equipment and the mutual recognition of their conformity.

O Governo, através do Secretário de Estado das Infraestruturas, decidiu realizar uma consulta pública sobre o projeto de diploma que estabelece o regime da disponibilização no mercado, da colocação em serviço e da utilização de equipamentos de rádio, transpondo para a ordem jurídica interna a Diretiva n.º 2014/53/UE, do Parlamento Europeu e do Conselho, de 16 de abril 2014, relativa à harmonização da legislação dos Estados-Membros respeitante à disponibilização de equipamentos de rádio no mercado. Para tanto foi solicitada à ANACOM, a 9 de junho de 2016, a promoção dessa consulta, no quadro das suas atribuições de coadjuvação ao Governo. O projeto ora submetido a consulta revoga o Decreto-Lei n.º 192/2000, de 18 de agosto, que estabelece o regime de livre circulação, colocação no mercado e colocação em serviço no território nacional dos equipamentos de rádio e equipamentos terminais de telecomunicações, bem como o regime da respetiva avaliação de conformidade e marcação, que transpôs para a ordem jurídica interna as normas da Diretiva n.º 1999/5/CE do Parlamento Europeu e do Conselho, de 9 de março, relativa aos equipamentos de rádio e terminais de telecomunicações e ao reconhecimento mútuo da sua conformidade.
