Draft decision on the review of the BROTSoLL reference offer of Proximus for high-quality access services

On 13 December 2019, the BIPT adopted a decision regarding the analysis of the market for high-quality access. In that decision various obligations are imposed on Proximus, including the transparency obligation. This transparency obligation includes the publication of a reference offer, a document describing the information, tariffs and technical specifications of the regulated wholesale offer. Following that decision Proximus provided the BIPT with an update of the reference offer for active high-quality access, namely the BROTSoLL reference offer or “Proximus Reference Offer for Terminating Segments of Leased Lines” After a few additions asked by the BIPT this reference offer was submitted for informal pre-consultation to the sector. Based on the comments made a few provisions of the reference offer were analysed. The current draft decision discusses those aspects and is now submitted for public consultation. Het BIPT heeft op 13 december 2019 een besluit aangenomen betreffende de analyse van de markt voor hoogwaardige toegang. In dat besluit worden verschillende verplichtingen opgelegd aan Proximus, waaronder de transparantieverplichting. Deze transparantieverplichting omvat het publiceren van een referentieaanbod, een document waarin de informatie, tarieven en technische specificaties van het gereguleerde wholesaleaanbod worden beschreven. In opvolging van dit besluit bezorgde Proximus het BIPT een update van de referentieaanbieding voor actieve hoogwaardige toegang, zijnde de BROTSoLL-referentieaanbieding of “Proximus Reference Offer for Terminating Segments of Leased Lines”. Na enkele aanvullingen gevraagd door het BIPT, werd dit referentieaanbod tijdens een informele preconsultatie voorgelegd aan de sector. Op basis van de geformuleerde commentaren werden enkele bepalingen in dit referentieaanbod verder onderzocht. Het huidige ontwerpbesluit bespreekt deze aspecten, en wordt nu voorgelegd voor publieke raadpleging. Antwoordtermijn: tot 10 mei 2021.
