The Council of State rejects appeals of the Arcep Decision on the market for access to local passive solutions

Through its decision of 17 December 2024, the Council of State (Conseil d’Etat) has rejected the appeals filed by the firms Bouygues Telecom, Free SAS and SFR of the Arcep Decision[1] on the definition of the relevant market for wholesale local access provided at a fixed location, on the designation of an operator with significant power in this market (i.e. the SMP operator) and on the obligations imposed on that operator as a result. This Arcep Decision was adopted as part of the 7th round of fixed broadband and superfast broadband market analysis, covering the years 2024 to 2028.

Par sa décision du 17 décembre 2024, le Conseil d’Etat rejette les recours des sociétés Bouygues Telecom, Free SAS et SFR dirigés contre la décision de l’Arcep[1] portant sur la définition du marché pertinent de fourniture en gros d’accès local en position déterminée, sur la désignation d’un opérateur exerçant une influence significative sur ce marché et sur les obligations imposées à cet opérateur à ce titre. Cette décision de l’Arcep a été adoptée à l’occasion du 7ème cycle d’analyses de marché du haut débit et du très haut débit fixes, couvrant les années 2024 à 2028.
